Can Africa Regulate AI on Its Own Terms?
African nations are rushing to adopt foreign AI frameworks like the EU AI Act to signal global readiness. But adopting rules designed for Western economies without the local institutional capacity to enforce them risks creating 'ghost policies.' Africa must shift from keeping up with global standards to leading with context-aware, sovereign AI governance.
Eleven African countries made the top 100 of the 2025 Government AI Readiness Index, with Egypt at 51st (Oxford Insights). This shows that Africa is not struggling to signal AI readiness but that the rules do not fit its realities. African nations in keeping up with the fast moving conversation on AI governance are aligning their AI policies with the EU’s risk-based AI Act. Even though the EU AI Act is considered a global benchmark, African nations cannot afford to simply align with it. A multi-year regulation put together to cater to European concerns cannot be a fine fit for African priorities.
How Keeping Up Can Resemble Leading
The AU Continental AI Strategy, though development-driven, suggests that Member States take a leaf from global best practices while aligning with existing continental frameworks. But when you pull back the covers, the policy details of several nations reveal the EU AI Act serves as the reference point. African frameworks become the adaptation creating a version of progress where the race is run on the fuel from someone else’s judgement.
When peculiarities such as where regulation is needed and where it stifles growth is not given the needed attention, the purpose of the policy is defeated. The tension is not pace or agility. At least fifteen African countries have published their National AI frameworks including Nigeria and Kenya.
As captured in the MIT Technology Review by Melody Musoni, a policy and digital governance expert, “We want to be standard makers, not standard takers”. Because while keeping up with AI governance is one thing, leading it is another, and it is the latter that produces outcomes that shape local impact.
How Europe Became the World’s Default Regulator
The EU AI Act shapes global regulatory standards because the market is a large one that companies cannot afford to ignore. The Brussels Effect is the ripple effect where other countries model EU legislation, and in this case, it has become the world’s default AI regulator.
Since the EU AI Act is a strict standard, multinational companies take the efficient approach, building one product to the standard and then selling it everywhere. This makes Europe’s floor the World’s floor.
This pattern is playing out in Africa despite its unique risk profile as African governments are faced with the commercial pressure to mirror the EU AI Act.
The Data Protection Experiment That Should Have Been a Tell
When the EU passed the General Data Protection Regulation (GDPR) in 2016, no African country was considered compliant, putting the $14 billion export industry at risk. African nations eventually passed data protection laws that mostly aligned with the GDPR.
Years down the line, the data shows this alignment came at a cost. There has been a negative correlation between GDPR-inspired data protection laws and intra-regional digital trade in Africa, particularly for lower-income economies. While the regulation is designed to protect consumers, it also raised barriers between African countries trading with each other.
Aside from the negative impact of intra-regional trade, low corporate compliance persists across the continent.
Ghana’s Data Protection Act, 2012, mostly mirrored European privacy standards but failed to fit Ghana’s social, cultural, and economic context. A 2024 study of the digital agricultural service providers in Ghana showed that only 17 of the reviewed 30 providers complied with Ghana’s 2012 Data Protection Act.
A low public awareness for data privacy protection, bureaucracy and high cost of compliance, cold turkey transition, and resource constraints for enforcement have kept compliance rate low and the policy a ghost policy.
The consequence with data protection laws was a downturn in intra-regional trade and an enduring enforcement paralysis. With AI regulation, a repeat of this script is likely, with a new layer including: loose labour protections, innovation stifled by high regulatory compliance costs, and the exclusion of local languages from the LLMs shaping how Africans access information.
The Risks Africa Actually Faces
The EU AI Act determines risk by what AI does at the product level. In Africa, the risk starts before. Africa mines the cobalt that powers AI hardware. African workers label the data that trains AI models. African languages are used for benchmarks while remaining unserved.
The deployment risks compound this. Eleven African countries have spent over $2 billion on AI surveillance systems. The EU AI Act bans real-time biometric surveillance. The same technology, sold by vendors beyond the EU jurisdiction operates without similar constraints.

A sustainable AI policy for African nations needs to match the varying contexts to ensure the regulation does not exist without the protection or enforcement layer.
In recent years, governments have begun deploying AI-driven Labour Market Information Systems to match citizens to jobs. This works well in the West as the labour market is largely formal with verifiable employment histories.
However, in Africa where 85% of the 900 million working population are in informal sectors, a system trained to rank candidates based on formal labour data cannot be fully relied on. The system must be adapted to capture the working experience of the roadside food vendor or the skilled artisan without formal data before the system can be declared fair.
AI regulatory frameworks mirrored after the EU model assumes the EU’s starting point which is the wrong one for Africa.
The Governance Models Built on African Ground
The AU’s Digital Transformation Strategy, adopted in 2024 champions a local first principle rooted in the African Philosophy of Ubuntu. This governance framework asks “who benefits, who is harmed, and who was consulted.”
The governance logic hence starts with distribution not classification. It is who the technology serves and whether the people it serves have a hand in building it.
The Rwandan national AI policy was built based on this approach through consultations with over 120 participants across private sector, public sector, academic, and civil society actors.
Kenya’s AI Strategy 2025-2030 centres data sovereignty, promoting Swahili AI and agriculture-focused solutions that fit local conditions.
Other nations that have also avoided the top-down approach include Nigeria and Ghana. Ghana built its strategy through a consultation with 40-plus local stakeholder consultants across startups, telecoms, academia, and public institutions. In Nigeria, the strategy was co-created with top AI researchers of Nigerian descent across the world.
The through line is the sequence. Starting with local context and building outwards keeps AI Africa-centric.
The Gap Between Passing a Law and Enforcing One
A law without enforcement is reduced to a statement of intent, and enforcement is necessary to protect citizens. To implement penalties and enforce obligations, regulators, inspectors, appeal pathways, and a budget are needed.
The kind of regulation modeled after the EU AI Act often does not factor in the big budget and technical staff that EU regulatory bodies rely on.
Several African countries still have underfunded data authorities. AI governance that addresses issues like bias, safety, and fairness demands considerably more.
As Africa houses only 3% of the global talent pool, enforcement faces another roadblock, as regulation is only enforceable after technical interrogation.
Fair enforcement also needs the law to be a reflection of the people it protects. Foreign consultants bring frameworks and resources but they remain guided by the contexts they know, which are not African realities.
Local tech startups, nonprofits, grassroot organisations, and local researchers are better positioned to identify where compliance will kill innovation, the provisions existing enforcement infrastructure cannot back, and the conditions most suited to the local environment.
Google, Meta, and Microsoft have supported the drafting of Nigeria’s National AI strategy. GIZ, the EU, and Luminate are actively present in AI governance development across the continent. Local consultants must also be in the picture to avoid writing regulations that are a better fit for foreign authors than the institutions meant to enforce it.
African nations must therefore ensure their focus is centered on local priorities, such as making local consultants an integral part of the policy development team, setting up data regulators to enforce compliance, and building facilities toward institutional independence.
What World-Class Actually Means From Here
World-class AI regulation in Africa is not about how closely it mirrors the EU AI Act or the US AI framework. The measure is how well it protects citizens, enables innovation, and reflects African realities while meeting international standards.
Such grounded frameworks must be iterative and responsive, and this is only possible with testing and collaboration.
Regulatory sandboxes create the space for systems to be deployed under controls, to observe outcomes, and adjust the rules before scale.
And this cannot be made possible in isolation, without the participation of those building, deploying, and affected by AI systems. This collaborative model creates a working system that can be enforced and adapted.
Where This Leaves Us
Africa’s AI governance is at a solid inflection point that requires decisive, immediate action for growth. It is no longer a question of whether Africa can regulate AI on its own terms; governments must shift from keeping up to leading because it is clear that an African-centric standard is possible.
